Milimani Court Grants Juja MP Koimburi Bail in Sh10m Land Fraud Case

The Milimani Magistrate’s Court has granted Juja Member of Parliament George Koimburi release on a Sh100,000 cash bail after he denied four charges of conspiracy to defraud in a disputed Sh10 million land deal.
According to the charge sheet, Koimburi, together with Shelmith Karungri Maina and Gathi Irungu, allegedly conspired to defraud businessman Julius Gitonga of a 1.31-hectare piece of land situated in Ruiru East/Juja East. The property is valued at Sh10 million.
During Monday’s proceedings, the MP’s defence team pressed for his release on a free bond.
They told the court that the complainant had already signaled willingness to withdraw the case and that Koimburi had shown good faith by attending all sessions as required.
“The accused is a sitting legislator and risks losing his parliamentary seat if he fails to attend eight consecutive sittings. There is no possibility of him absconding,” his lawyer submitted.
The prosecution objected to the application for a free bond but indicated it had no issue with the MP being released on more lenient terms.
Prosecutors also revealed that the Director of Public Prosecutions (DPP) had earlier written to the court requesting a review of the charges.
Meanwhile, the second accused, Maina, is already out on a Sh100,000 cash bail. The third accused, Irungu, did not enter a plea after his lawyer informed the court that he was unwell and receiving treatment outside the country.
The magistrate, after hearing submissions from both parties, fixed the matter for mention on October 22 at 9:00 a.m. at the Milimani Law Courts.
